Vidyut Sahayogi and affiliates expressly disclaims overrides and excludes all warranties of any kind, whether express or implied, arising by law, custom, prior oral or written statements by Vidyut Sahayogi (including, but not limited to any warranty of merchantability, fitness for a particular purpose).
Vidyut Sahayogi assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any member communications or personalization setting. In order to use the Service, you must obtain access to the World Wide Web, either through mobile network data transfer (e.g. GPRS/EDGE/3G etc) or other wireless internet service (e.g. WiFi), and be responsible for any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a mobile phone and other access device.
Vidyut Sahayogi makes no warranty that (a) the Service will meet your requirements, (b) the Service will be uninterrupted, timely, secure, or error-free, (c) the results that may be obtained from the use of the Service will be accurate or reliable, (d) the quality of any products, services, information obtained by you through the Service will meet your expectations, (e) any errors in the software will be corrected. Any material download or otherwise obtained through the use of Vidyut Sahayogi is done at your own discretion and risk and that you will be solely responsible for any damage to your phone system or loss of data that results from the download of any such material.
Termination:
You reserve the rights to terminate the use of Vidyut Sahayogi at anytime. Vidyut Sahayogi reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Vidyut Sahayogi shall not be liable to you or to any third party for any modification, suspension or discontinuance of that Service.

Vidyut Sahayogi respects the intellectual property of others, and we ask Vidyut Sahayogi users to do the same. If you believe that your work has been copied in a way that constitutes any infringement, please provide Vidyut Sahayogi the following information:

Any information retained in WBSEDCL server logs will be maintained and protected in accordance with the WBSEDCL Privacy Policy. Public Content posted or distributed on Vidyut Sahayogi You acknowledge that Vidyut Sahayogi does not pre-screen Content, but that Vidyut Sahayogi and its designees shall have the right (but not the obligation) in their sole discretion to refuse or (re)move any Content that is available via the Service. WBSEDCL shall handle all personal data submitted through "Vidyut Sahayogi" in accordance with the relevant provisions of the Personal Data (Privacy) Ordinance. WBSEDCL will record visits via Vidyut Sahayogi without collecting any personal identifiable information of Users. Such general statistics are collected for the compilation of statistical reports are the diagnosis of problems with or concerning computer systems to help WBSEDCL improve Vidyut Sahayogi service.
Billing & payment related disclaimer

This shall be guided by the policy adopted by WBSEDCL in lieu of regulation published by Hon'ble WBERC time to time.
Disclaimer related to online payment:
Auto generated transaction /payment receipt would be sent to your valid mobile number and email id. If payable amount is debited/charged from your bank account /card but somehow you do not receive the transaction/payment receipt then you can do any of the following:
A) You can download the receipt from our website within 4 working days subject to receive payment confirmation from your bank/card issuing authority through the concerned payment gateway to WBSEDCL.
B) Before retry , please wait for at least 4(four) working days as stated above.
C) If you want to re-try to make payment against the same bill to avoid consequences due to uncertainty of payment confirmation from your bank/card issuing authority to WBSEDCL or you do not be able to download last concerned receipt after 4(four) working days then you have to take up the matter with the respective bank/card issuing authority for refund of the previous unsuccessful transaction. WBSEDCL will not be responsible for such of refund. In case of double payment , confirmed by your bank/card issuing authority in due time, excess payment amount(if any) or such extra payment will be adjusted in the other unpaid bills/immediate subsequent bill(s).
*Additional Rs.4+applicable service tax will be realised from the consumer as transaction charge to avail "Net Banking(Powered by BillDesk)" facility as optional payment mechanism.
*Additional 0.8*%(of payable amount)+applicable service tax will be realisedfrom the consumer as transaction charge to avail credit/debit card facility as optional payment mechanism.

Payment Gateway/Net Banking Disclaimer:Bill payments by you to WBSEDCL may be made through an electronic and automated collection and remittance service (E-Payment using Net-banking, Debit/Credit Card through Payment Gateway) hosted by WBSEDCL's designated bank. The e-payment service is provided to you in order to facilitate access to view and pay your bills online. WBSEDCL makes no representation of any kind, express or implied, as to the operation of the Payment Gateway. You expressly agree that your use of this online payment service is entirely at your own risk.
Transaction charge:You will borne the necessary transaction charge plus service tax as applicable for online payment of your electricity bill as optional payment mechanism. This charge will be taken by e-payment solution provider for giving this service.
Receipt generation:You will get receipt of exact bill amount paid by you.
Debit/Credit card/Net banking details: The debit/credit card/ Net banking details provided by you for use of the Payment Gateway/ Internet Banking will be correct and accurate and you shall not use a debit/credit card/ Net Banking which is not lawful ly owned by you. You further agree and undertake to provide correct and valid debit/credit card / Net Banking details. In default of the above conditions the Company shall be entitled to recover the amount of transaction from the consumer against whose electricity bill the credit / debit card/ Net banking has been used. Further, the Company also reserves the right to initiate any legal action for recovery of cost / penalty or any other punitive measure, as it may deem fit.
Intellectual Property Rights Indemnity: The Licenser shall indemnify Licensee against any claim that in the normal use of possession of the Licensed Program Material infringes the intellectual property rights of any third party provided that the Licensor is given immediate notice of such claim that the claim does not arise as result of the use of Licenced Program. Materials in conjunction with any equipment not approved by the Licensor. The Licensor shall have the right to replace , modify ,change or alter any part of licenced program Materials to avoid infringements. The foregoing declares the entire liability is on the Licensor and not the Licensee in respect of infringements of intellectual property rights of any third party.
Limitation of Liability: WBSEDCL has made this service available to you as a matter of convenience. WBSEDCL expressly disclaims any claim or liability arising out of the provision of this service. You agree and acknowledge that you shall be solely responsible for your conduct and that WBSEDCL reserves the right to terminate your rights to use the service immediately. In no way shall WBSEDCL or its affiliates be liable for any direct, indirect, incidental, special,consequential or exemplary damages,including but not limited to, damages for loss of profits,goodwill, data or other intangible losses arising out of or in connection with use of the Payment Gateway. WBSEDCL assumes no liability whatsoever for any monetary or other damage suffered by you on account of (i) the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Payment Gateway/ Internet Banking/debit card/credit card; or (ii) any interruption or errors in the operation of the Payment Gateway/ Internet Banking /debitcard/credit card. You shall indemnify and hold harmless WBSEDCL and their respective officers, directors, agents, and employees, from any claim or demand, or actions. You agree, understand and confirm that personal data including without limitation details relating to debit card/credit card/ Net Banking transmitted over the internet is susceptible to misuse, theft and/or fraud and that WBSEDCL has no control over such matters. Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by you, WBSEDCL does not represent or guarantee that the use of the payment gateway/ Internet Banking will not result in theft and/or unauthorized use of data over the internet.

IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE.
1. LICENSE
By installing and/or using Vidyut Sahayogi ("Software") containing this software, you agree that this End User License Agreement (EULA) is a legally binding and valid contract and agree to be bound by it. You agree to abide by the intellectual property laws and all of the terms and conditions of this agreement.
Your use of Vidyut Sahayogi indicates your acceptance of this license agreement and warranty.
Subject to the terms of this Agreement, WBSEDCL grants to you a limited, non-exclusive, non-transferable license, without right to sub-license, to use Vidyut Sahayogi in accordance with this Agreement and any other written agreement with WBSEDCL. WBSEDCL does not transfer the title of Vidyut Sahayogi to you; the license granted to you is not a sale. This agreement is a binding legal agreement between WBSEDCL and the customers of WBSEDCL.
If you do not agree to be bound by this agreement, remove Vidyut Sahayogi from your device.
2. DISTRIBUTION
Vidyut Sahayogi and the license herein granted shall not be copied, shared, distributed, re-sold, offered for re-sale, transferred or sub-licensed in whole or in part except that you may make one copy for archive purposes only.
3. USER AGREEMENT
3.1 USE
Your license to use Vidyut Sahayogi is limited to the number of licenses purchased by you. You shall not allow others to use copy or evaluate copies of Vidyut Sahayogi.
3.2 USE RESTRICTIONS
You shall use Vidyut Sahayogi in compliance with all applicable laws and not for any unlawful purpose.
3.3 COPYRIGHT RESTRICTION
This Software contains trade secrets and other proprietary material. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile Vidyut Sahayogi [respective installed version]. Nor can you create any derivative works or other works that are based upon or derived from Vidyut Sahayogi in whole or in part.
WBSEDCL's name, logo and graphics file that represents Vidyut Sahayogi shall not be used in any way to promote products developed with Vidyut Sahayogi. WBSEDCL retains sole and exclusive ownership of all right, title and interest in and to Vidyut Sahayogi and all Intellectual Property rights relating thereto.
International copyright treaty provisions protect all parts of Vidyut Sahayogi, products and services. No program, code, part, image, audio sample, or text may be copied or used in any way by the user except as intended within the bounds of the single user program. All rights not expressly granted hereunder are reserved for WBSEDCL.
3.4 LIMITATION OF RESPONSIBILITY
You will indemnify, hold harmless, and defend WBSEDCL, its employees, agents and distributors against any and all claims, proceedings, demand and costs resulting from or in any way connected with your use of WBSEDCL's Software.
In no event (including, without limitation, in the event of negligence) will WBSEDCL, its management, employees, or vendors be liable for any consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss), in connection with or arising out of or related to this Agreement, Vidyut Sahayogi or the use or inability to use Vidyut Sahayogi or the furnishing, performance or use of any other matters hereunder whether based upon contract, tort or any other theory including negligence.
3.5 WARRANTIES
Except as expressly stated in writing, WBSEDCL makes no representation or warranties in respect of this Software and expressly excludes all other warranties, expressed or implied, oral or written, including, without limitation, any implied warranties of merchantable quality or fitness for a particular purpose.
3.6 GOVERNING LAW
This Agreement shall be governed by the law of the India applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the Calcutta High Court there from. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.
3.7 TERMINATION
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license. Upon termination of this license granted herein for any reason, you agree to immediately cease use of Vidyut Sahayogi and destroy all copies of Vidyut Sahayogi supplied under this Agreement.
4. DISCLAIMER OF WARRANTY
This software and the accompanying files are sold "as is" and without warranties as to performance or merchantability or any other warranties whether expressed or implied. This disclaimer concerns all files generated and edited by Vidyut Sahayogi as well.
5. CONSENT OF USE OF DATA
You agree that WBSEDCL may collect and use information gathered in any manner as part of the product support services provided to you, if any, related to Vidyut Sahayogi. WBSEDCL may also use this information to provide notices to you which may be of use or interest to you.
